The Head of Planning advised that he would be willing to hold discussions with the Priory School if they were minded to submit a revised application.  The Chairman confirmed that he would provide a personal written response to the questions raised prior to the next meeting of the Committee.

Comment:

The local member, Councillor Diana Tuson, spoke on this item.

 

Decision:

The Committee had taken into consideration and agreed with the reasons for the recommendation as set out under paragraph entitled Justification for Recommendation of the report and resolved:

 

(i)           Temporary conditional consent for 12 months.

 

(ii)         THAT a detailed letter be sent to the applicants accompanying the formal decision notice highlighting the amended and/or additional conditions, stressing the importance of condition no. 2, should they have any expectations of submitting an application to renew this temporary permission, and advising them that the Council, as Local Planning Authority, expect full compliance with the conditions at all times and that any breach of condition would be dealt with in the strongest possible terms. The letter should also include advice to the effect that the existing floodlighting system does not have the benefit of an extant planning permission and if they wish to retain this floodlighting in connection with the approved use they would need to submit an application prior to recommencement of the use.

 

The Environmental Health Officer to be notified and invited to carry out his own investigations during the temporary period.

 

Conditions:

1.     The use hereby approved shall be begun before the expiration of one year from the date of this permission. The Local Planning Authority shall be notified in writing within seven days of the date of any commencement of use.

 

Reason: To enable the Local Planning Authority to assess the noise impacts of the use for a trial period and to accord with Policies D1 (Standards of Design), P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

2.    The use hereby permitted shall be discontinued, the buildings removed and the land restored in accordance with an agreed scheme, on or before the expiration of one year from the date on which the use hereby approved recommenced on site, in accordance with a scheme of work to be submitted to and approved in writing by the Local Planning Authority, unless the prior written consent of the Local Planning Authority has been obtained for a further period.

 

Reason: To ensure the appropriate restoration of the site and to accord with Policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

3.    Prior to any commencement of activity on site a schedule and details of earth mounting/bundling to be constructed around the perimeter of the site shall be submitted to and approved in writing by the Local Planning Authority. Such an agreed scheme shall be implemented in accordance with the phasing scheme required by condition no. 4 of this consent.

 

Reason: To prevent disturbance from noise emission from the premises and to comply with Policies P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

4.    The construction of the earth moulding/bunding shall take place in accordance with a phasing programme agreed in writing by the Local Planning Authority.

 

Reason: To prevent disturbance from noise emission from the premises and to comply with Policies P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

5.   Prior to commencement of any activity on site a noise monitoring programme to be undertaken by both the developer and Local Authority shall be developed and agreed in consultation with the Local Planning Authority. Such an agreed programme shall be carried out by a competent person(s) and shall also provide for the monitoring of noise levels for an agreed period prior to the construction of the earth moulding/bunding required by condition no. 3.

 

Reason: To enable the Local Planning Authority to assess the noise impacts of the use for a trial period and to accord with Policies D1 (Standards of Design), P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

6.     The development permitted by this planning permission shall not be initiated until a planning obligation pursuant to section 106 of the Town and Country Planning Act 1990 has been made and lodged with the Planning Authority and the Local Planning Authority has notified the person submitting same that it is to the Local Planning Authority’s approval. The said Planning Obligation will provide for the payment of the Local Authority’s reasonable costs in monitoring noise levels as required by condition no. 5 of this consent.

 

Reason: To enable the Local Planning Authority to assess the noise impacts of the use for a trial period and to accord with Policies D1 (Standards of Design), P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

7.     No public address or amplified music systems shall be used on site at any time.

 

Reason: To prevent disturbance from noise emission from the premises and to comply with Policies P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

8.    No go-karts shall be operated on site before 1030 hours or after 2000 hours on Mondays to Saturdays or before 1200 hours or after 1900 hours on any Sundays or recognised Bank Holidays.

 

Reason: To prevent disturbance from noise emission from the premises and to comply with Policies P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

9.    No more than eight go-karts shall be operated on the site at any one time.

 

Reason: To prevent disturbance from noise emission from the premises and to comply with Policies P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan.

 

10.  Only go-karts powered by silenced four stroke motors, whose precise specifications are to be agreed with the Local Planning Authority before the use recommences, shall be used on site. No modified or race prepared karts, motorbikes, `mini motos` or any other motorised vehicles are to be used on the site without the express written prior consent of the Local Planning Authority.

 

Reason: To prevent disturbance from noise emission from the premises and to comply with Policies P1 (Pollution and Development) and P5 (Reducing the Impact of Noise) of the Isle of Wight Unitary Development Plan

(b)               Update Report on the Section 106 Agreement, Planning Conditions and Information Required for the Commencements of Development at Kingston, East Cowes

 

Outline Consent for 9.9ha of Residential Development; 9.9ha of Employment Development; Managed Woodland; Nature Conservation Areas; Proposed Access Road Junction with Whippingham Road and Beatrice Avenue; Network of Public Footpaths/Cycleways; Public Transport Link only to Kingston Road

 

Land Bounded by Kingston Farm Lane/Cadets Walk/Kingslea Park/Beatrice Avenue, East Cowes Power Station/Agricultural Land/South of East Cowes Vics Football Ground Including Land off Whippingham Road, East Cowes

 

Members were reminded that at the Development Control Sub Committee meeting held on 25 September 2006 it was resolved to grant planning permission for the above proposal.  The decision was referred to the Government Office for the South East as the proposal comprised over 150 dwellings in a greenfield location.  The Government Office had confirmed that the proposal together with that for the regeneration of East Cowes submitted by SEEDA and English Partnerships would not be ‘called in’ and as such planning permission could be issued.  Discussions had continued between the applicants and officers over the detailed wording of the Legal Agreement and the proposed planning conditions.

 

The Section 106 Agreement was now ready to be signed and Committee approval was sought for that.

 

An e mail had been received from the adjoining member Councillor Muriel Miller, who had been unable to attend the meeting, raising several points relating to part of the site being earmarked for marine use land, noise and dust and the management scheme to include Osborne Middle School.  An additional condition was to be included that the oil receptors be maintained.

 

RESOLVED :

 

(i)                 THAT the proposed conditions to be applied to the planning permission for Kingston be agreed.

 

(ii)               THAT delegated authority be given to officers if conditions need to be further adjusted.
