Title : PLANNING ENFORCEMENT QUARTERLY REPORT
REPORT OF THE DEVELOPMENT CONTROL MANAGER
SUMMARY
This report updates the statistical information considered
at the meeting of the Development Control Sub Committee Meeting held on 6 June
2006 and includes the figures for the second calendar quarter of 2006.
Notwithstanding the restructuring which has taken
place within the Development Control Team, resulting in the compliance officers
being absorbed into the area teams and the management of the enforcement
function being carried out by the Area Team Leaders, it is intended to continue
reporting the figures on an Island wide basis.

This is a mechanism through which a LPA can obtain
information relating to an alleged breach of planning control. It is obviously
an alternative to obtaining information by letter or seeking to verify certain
information if the source is considered to be unreliable.

In March 2005 powers came into force amending the
Town and Country Planning Act 1990 enabling the Local Planning Authority to
serve a Temporary Stop Notice against a breach of planning control where it was
considered necessary to safeguard the amenity of the area that the use/activity
should stop immediately. A notice can also be served where a developer fails to
comply with a planning condition.
OVERVIEW
Following the promotion of the West Area Enforcement
Officer into the Householder Team in March 2006 and because of a failed
re-deployment exercise involving a member of staff from another service who was
being made redundant, the post of West Area Compliance Officer remained vacant
for virtually the whole of the last quarter. This situation has now been
rectified with the appointment of a replacement officer who took up the
position on 20 July 2006.
The overall implications of the staff re-deployment
of February 2006, which saw the loss of the Enforcement Team Leaders post and
its impact on the planning enforcement service needs to be monitored. Whilst
the lead up time to the service of an enforcement notice can be several months,
the response time with regards to the service of a breach of condition notice
and planning contravention notice is more or less immediate. I consider that it
will require figures from at least one more quarter before any trend can be
established. The current number of outstanding complaints being handled by the
two Compliance Officers stands at approximately 245 cases.
