RESOLVED :

 

THAT the Minutes of the meeting held on 23 January 2007 be confirmed, subject to Minute 51 (b) (ii) being amended to read as follows :

 

‘THAT minor changes of wording be delegated to officers if conditions need to be further adjusted so long as those changes do not change the emphasis or the requirements of the conditions’.

The reasons for the resolutions made in accordance with Officer recommendation were given in the Planning report.  Where resolutions are made contrary to Officer recommendation the reasons for doing so are contained in the minutes.

Decision:

The application was refused contrary to officer recommendation because of the impact on the character of the area and the impact on the neighbouring properties in relation to the terrace of three.

 

In compliance with the Council’s Constitution a named vote was taken as the decision was contrary to officer recommendation.

Reasons:

The layout and design of the proposed units to be constructed together with the means of enclosure proposed would have a detrimental and urbanising impact on the character of the area contrary to Policies G4 (General Locational Criteria), D1 (Standards of Design) and D2 (Standards of Development within the Site) of the Isle of Wight Unitary Development Plan.

 

The proposed units 1 - 3 would give rise to an unacceptable level of overlooking of adjacent properties to the detriment of the amenities of occupiers of those properties and would therefore be contrary to Policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

Comment:

No demolition to take place until the replacement build has been approved.

 

Material be salvaged and reused on site.

 

Further explore the capture and re-use of storm water.

 

Decision:

The Committee had taken into consideration and agreed with the reasons for the recommendation as set out under paragraph entitled Justification for Recommendation of the report and resolved:

 

Conditional Planning Permission, subject to the conditions set out in the Part II Register.

 

Conditions:

The following condition shall be amended to read as follows:

 

Condition 3:   None of the flats hereby approved shall be used other than holiday accommodation and shall not be occupied as a main or permanent residence.

 

                        Reason: To ensure that the development remains for holiday purposes and to comply with policies T1 (Tourism) and T3 (Holiday Accommodation) of the Isle of Wight Unitary Development Plan.

 

The following conditions to be added:

 

10.      A comprehensive occupancy register of the apartments hereby approved shall be maintained to include names and home addresses of all occupants and the said register shall be made available to the Local Planning Authority with a minimum of 48 hours notice.

 

           Reason: to ensure that the development remains for holiday purposes and to comply with Policies T1 (Tourism) and T3 (Holiday Accommodation) of the Isle of Wight Unitary Development Plan.

 

UN1. No demolition work shall commence until such time as an application for Approval of Reserved Matters or Full Planning Permission has been granted by the Local Planning Authority for the redevelopment of the site.

 

Reason: In the interests of protecting the amenities and character of the area in accordance with Policies G4 (General Locational Criteria) and D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

UN2. No demolition works authorised by this consent shall take place until a programme of building recording has been undertaken to identify those materials from the existing building which shall be reclaimed for reuse in the redevelopment of the site.

 

Reason: In the interests of protecting the amenities and character of the area in accordance with Policies G4 (General Locational Criteria) and D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

UN3 Any work undertaken on site shall be done in complete accordance with the details and recommendations contained within the tree report and Arboricultural Method Statement submitted to and approved by the Local Planning Authority.

Reasons:

The  proposal would represent  an overdevelopment of the site at an excessive density which in turn would create conditions likely to give rise to overlooking, loss of outlook and would  be of  an overbearing  nature to the detriment  of prospective occupants of the development as well as  being out of character with the prevailing pattern of development  in the surrounding area and was contrary to  Policy S6 (To be of a high standard of design) and  Policy D1 (Standards of design) and Policy D2 (Standards of development within  the site)  of the Isle of Wight Unitary Development Plan.

 

The introduction of the dormer windows in the rear roof slope would, given the relationship to the rear of the properties beyond, result in a loss of privacy and amenity to the occupants of those  adjoining properties and would therefore be contrary to Policy D1 (Standards of design) of the Isle of Wight Unitary Development Plan.

Additional Representations:

East Cowes Town Council had no objection to the development of three residential units.

 

The following additional comments were received from Southern Water :

 

Southern Water would prefer that surface water is disposed of by means of soakaways or discharged into water courses.  This may not always be possible and surface water sewers are sometimes available to service development. However, in many older areas subject to redevelopment only a combined (mixed foul and surface water) sewer is available. In this case we would prefer that surface water is disposed of by some other means. If none is available we would allow as a last resort “no net increase in flow” i.e. The total flow from the new development would be no greater than from the original site. We would require proof of the scale of the original flow by means of a topographical survey, flow tests, photographs etc. to establish the level of flow. The foul flow should have a free discharge but the surface water may require to be attenuated to limit the flow from the redeveloped site.

 

Percolation of surface water into the soil would be a good option for southern Water as it prevents surface water entering the combined sewer. In this case Southern Water agrees that the percolation system is not acceptable in this location.

 

You are correct in stating that Southern Water is content for the surface water to enter the combined sewer in a controlled manner subject to the appropriately designed attenuation measure.

 

We request that should this application receive planning approval following condition is attached. Construction of the development shall not commence until details of the proposed means of foul and surface water sewage disposal have been submitted to, and approved in writing, by the Local Planning Authority in consultation with Southern Water.

 

Comment:

The use of a grey water system be investigated.

 

Decision:

The Committee had taken into consideration and agreed with the reasons for the recommendation as set out under paragraph entitled Justification for Recommendation of the report and resolved:

 

Conditional Planning Permission, subject to the conditions set out in the Part II Register.

 

Conditions:

The following conditions to be added :

 

Before any development commences on site a scheme for the capture and storage of rain water together with details of its proposed use as part of a grey water recycling system shall be submitted and agreed in writing with the Local Planning Authority. The approved scheme shall then be installed into the dwellings hereby approved before they are first occupied and shall be retained hereafter.

 

Reason: To reduce the demand and pressures on the local combined sewer system and to comply with Policy U11 (Infrastructure and Service Provision) of the Isle of Wight Unitary Development Plan.

 

Before any development is commenced on site a management plan to regulate construction workers parking requirements and the delivery/collection/unloading of materials associated with the construction of the development hereby approved shall be submitted and agreed in writing with the Local Planning Authority.   The developer shall ensure that all traffic adheres to the agreed scheme during the life of the development.

 

Reason: In the interests of highway safety and to comply with Policy TR7 (Highway Considerations) in the Isle of Wight Unitary Development Plan.

(b)               Planning Enforcement Quarterly Report

 

The planning enforcement quarterly report gave an up date of the statistical information considered at the November meeting of the Sub Committee and included figures for the forth calendar quarter of 2006.

 

Members asked if a replacement post holder had been appointed for enforcement and were advised that a Compliance Officer for the East Team was due to start work and interviews had been held for the other post.

The Committee asked questions relating to the lack of action being taken by the authority with regard Enforcement Notices being ignored by developers.

 

Questions were raised with regard to the correct people from Southern Water attending meetings with the Council.  It was also suggested that the Environment Agency and OFFWAT be invited to attend any future meetings held with Southern Water.

 

RESOLVED :

 

THAT the report be noted.

 

(c)               Schedule of Planning Appeals as at 31 December 2006

 

The Committee was advised that the summary of planning appeals for the half year ending 31 December 2006 was good, with the outcomes being above the national average.  That was mainly due to the fact that the high quality of the Council’s Appeal Officer.

Members asked if the Barratts appeal was to be withdrawn and were advised that as soon as their Decision Notice was issued the appeal would be withdrawn.

 

RESOLVED :

 

THAT the report be noted.

 

56.             MEMBERS' QUESTION TIME

 

Cllr Julian Whittaker asked when the road works were going to be completed in South Street, Newport, now that the Bus Station development had been completed; they were supposed to have been completed within 6 weeks of completion.
