SCHEDULE OF OUTSTANDING SECTION 106 OBLIGATIONS

 

SUMMARY

 

To apprise Members of outstanding Section 106 obligations.

 

REPORT

 

Attached as an appendix to this report is a schedule of currently outstanding Section 106 obligations, i.e. ones that have yet to be signed as well as any completed in the previous quarter.

 

Although the report is headed as being quarterly, it does in fact cover the last four months.  The reason for this is the extended time lapse since the last meeting of the Committee on 12 April.  It is, however, proposed that in future the schedule is to be placed on the agenda at quarterly intervals.

 

The schedule attached hereto is not the same as the one officers’ maintain of completed Section 106 obligations which is the subject of continued monitoring and review to ensure compliance with the obligations.  These may consist of works (e.g. highway/junction improvements, provision of affordable housing, etc.) or cash payments (perhaps in stages or at certain trigger points).

 

There is within the Planning Service, a dedicated Section 106 Officer whose role is to undertake these duties.

 

Officers are proposing to impose a requirement on applicants to conclude a Section 106 Agreement with a specified time period (likely to be three months) for all but the most complicated) or the application will be reverted back for determination on the basis on an unwillingness to enter into one.

That Members offer their comments on this latest initiative.
