Conditions as follows :

 

1.     The development hereby permitted shall be begun before the expiration of 3 years from date of this permission.

 

Reason:  To comply with Section 91 of the Town and Country Planning Act 1990.

 

2.     No development shall take place until details of the materials and finishes, to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the Local Planning Authority.  Development shall be carried out in accordance with the approved details.

 

Reason:  In the interests of the amenities of the area and to comply with policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

3.    No development shall take place until full details of both hard and soft landscape works have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved.  These details shall include [proposed finished levels or contours; means of enclosure; car parking layouts; other vehicle and pedestrian access and circulation areas; hard surfacing materials; minor artefacts and structures (eg. refuse or other storage units, signs, lighting, etc); proposed and existing functional services above and below ground (eg. drainage power, communications cables, pipelines, etc, indicating lines, manholes, supports, etc).

 

Reason:  To ensure the appearance of the development is satisfactory and to comply with policy D3 (Landscaping) of the Isle of Wight Unitary Development Plan.

 

 

4.   All hard and soft landscape works shall be carried out in accordance with the approved details.  The works shall be carried out prior to the occupation of any part of the development or in accordance with the programme agreed with the Local Planning Authority.

 

Reason:  In the interests of the amenities and character of the area and to comply with policy D3 (Landscaping) of the Isle of Wight Unitary Development Plan.

 

5.   Any area of the site which has been incorporated in a landscape scheme or on which landscape works have been carried out in accordance with this permission shall not thereafter be used for any purpose other than as a landscaped area. 

 

Reason:  In the interests of maintaining the amenity value of the area and to comply with policy D3 (Landscaping) of the Isle of Wight Unitary Development Plan.

 

6.   No development shall take place until details have been submitted to and approved in writing by the Local Planning Authority of the positions, design, materials and type of boundary treatment to be erected.  The boundary treatment shall be completed before the buildings hereby permitted are occupied in accordance with a timetable agreed in writing with the Local Planning Authority.  Development shall be carried out in accordance with the approved details.

 

Reason:  In the interests of maintaining the amenity value of the area and to comply with policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

7.    The use of the garage/workshop building hereby permitted shall be limited to the servicing and MOT testing of motor vehicles. No vehicle body work repairs shall be carried out on the land or in the buildings at any time without any further planning permission.

 

Reason: In the interests of the amenity of neighbouring residents and to comply with Policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

8.   No industrial process as defined in the Town and Country Planning (Use Classes) Order 1987 (or any Order revoking and re-enacting that Order with or without modification) shall be carried on at the premises outside the garage/workshop building hereby approved.

 

Reason:  In the interests of the amenities of the area and to comply with policy P1 (Pollution) and D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

9.  No equipment crates, packing materials, derelict vehicles, vehicle bodies or waste materials shall be stacked or stored on the site at any time except within the buildings or storage areas identified for those purposes on the approved plans.

 

Reason:  In the interests of the visual appearance of the site and the visual amenity of the surrounding area and to comply with policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

10.  No machinery shall be operated nor shall work take place within the site outside of the hours of 7.30 am to 6.00 pm Mondays to Fridays inclusive and 7.30 am to 1.00 pm Saturdays, nor Sundays or officially recognised public holidays.

 

Reason: In the interests of the amenity of neighbouring residents and to comply with Policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

11.  Details of the machinery to be used within the garage/workshop building hereby approved shall be submitted to and agreed in writing by the Local Planning Authority.

 

Reason: In the interests of the amenity of neighbouring residents and to comply with Policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan

 

12.   No external lighting of any kind shall be installed within the site without first being agreed in writing by the Local Planning Authority.

 

Reason: To protect the character and appearance of the area and the amenities of neighbouring residents and to comply with Policies C1 (Protection of Landscape Character), C2 (Areas of Outstanding Natural Beauty) and D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

13.   No development approved by this planning permission shall be commenced until:

 

a)   A desktop study has been carried out which shall include the identification of previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. And using this information a diagrammatical representation (Conceptual Model) for the site of all potential contaminant sources, pathways and receptors has been produced.

 

b)  A site investigation has been designed for the site using the information obtained from the desktop study and any diagrammatical representations (Conceptual Model). This should be submitted to, and approved in writing by the Local Planning Authority prior to that investigation being carried out on the site. The investigation must be comprehensive enough to enable:

-   a risk assessment to be undertaken relating to groundwater and surface waters associated on and off the site that may be affected, and

 

-   refinement of the Conceptual Model, and

 

- the development of a Method Statement detailing the remediation requirements.

 

c)   The site investigation has been undertaken in accordance with details approved by the Local Planning Authority and a risk assessment has been undertaken.

 

d)  A method statement detailing the remediation requirements, including any proposals to change the ground levels and measures to minimise the impact on ground and surface waters, using the information obtained from the Site Investigation has been submitted to the Local Planning Authority. This should be approved in writing by the Local Planning Authority prior to that remediation being carried out on the site.

 

Reason: To ensure that the proposed site investigations and remediation will not cause a pollution of Controlled Waters.

 

14. The development of the site should be carried out in accordance with the approved Method Statement.

 

Reason: To ensure that the development complies with approved details in the interests of protection of the environment and harm to human health.

 

15.  If during development, contamination not previously identified, is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority, for an addendum to the Method Statement.  This addendum to the Method Statement must detail how this unsuspected contamination shall be dealt with and from the date of approval the addendum(s) shall form part of the method statement.

 

Reason: To ensure that the development complies with approved details in the interests of protection of the environment and harm to human health.

16. Upon completion of the remediation detailed in the Method Statement a report shall be submitted to the Local Planning Authority that provides verification that the required works regarding contamination have been carried out in accordance with the approved Method Statement(s). Post remediation sampling and monitoring results shall be included in the report to demonstrate that the required remediation has been fully met. Future monitoring proposals and reporting shall also be detailed in the report.

 

Reason: To protect the environment and prevent harm to human health by ensuring that the remediated site has been reclaimed to an appropriate standard.

 

17. No changes to ground levels shall be made within the application site, unless previously agreed in writing by the Local Planning Authority as part of the Land Contamination Remediation method Statement.

 

Reason: To protect the character and appearance of the area and to comply with Policies C1 (Protection of Landscape Character), C2 (Areas of Outstanding Natural Beauty) of the Isle of Wight Unitary Development Plan.

 

18. Soakaways shall only be used in areas on site where they would not present a risk to groundwater. If permitted their location must be approved in writing by the Local Planning Authority.

 

Reason: To prevent pollution of controlled waters.

 

19.  A system for the proposed capture, containment, treatment and subsequent disposal of all surface water within the application site shall be submitted to and agreed in writing by the Local Planning Authority before the development hereby approved is commenced. The surface water disposal system shall then be implemented in accordance with the approved details.

 

Reason: To protect the adjoining Site of Special Scientific Interest and to ensure that no pollutants escape from the site and in accordance with Policy C10 of the Isle of Wight Unitary Development Plan.

 

20.  Prior to being discharged into any watercourse, surface water sewer or soakaway system, all surface water drainage from parking areas and hardstanding shall be passed through an oil interceptor that has been constructed in accordance with details submitted to and approved in writing by the Local Planning Authority.  Roof water shall not be permitted to pass through the interceptor.

 

Reason:  To minimise the risk of pollution and to comply with policy P1 (Pollution and Development) of the Isle of Wight Unitary Development Plan.

 

21.  No construction works involving percussive piling or works with heavy machinery shall take place within the waterfowl over wintering period, 1 October to 31 March inclusive, unless agreed in writing with the Local Planning Authority.

 

Reason: To avoid noise and disturbance to waterfowl and to comply with the Wildlife and Countryside Act 1981.

 

22. Development shall not begin until the improvements to the junction of Gasworks Lane with Bridge Road have been implemented, in accordance with the approved details (drawing 2412/06A). These improvements shall be thereafter maintained in a good state of repair.

 

Reason:  To ensure adequate access to the proposed development and to comply with policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

23.  Upon completion of the developments construction phase, and before the use commences, details of the design and location for the installation of 2 speed bumps on Gasworks Lane with the intention of reducing vehicles speed shall be submitted in writing and agreed with the Local Planning Authority and implemented.

 

Reason:  In the interests of highway safety and to comply with policy TR7 (Highway Considerations) of the Isle of Wight Unitary Development Plan.

 

24.  Upon completion of the development's construction phase, the surface of Gasworks Lane shall be overlaid with 30mm of appropriate wearing course material (to be agreed with the Local Planning Authority) The surface of the lane shall thereafter be maintained in a good state of repair.

 

Reason:  In the interests of highway safety and comply with policies TR7 (Highway Considerations) and M2 (Defined Mineral Working) of the Isle of Wight Unitary Development Plan.

 

25.  No building hereby permitted shall be occupied until space has been laid out within the site and drained and surfaced in accordance with details that have been submitted to and approved by the Local Planning Authority in writing for cars to be parked and for vehicles to be loaded and unloaded and for vehicles to turn so that they may enter and leave the site in forward gear.  The space shall not thereafter be used for any purpose other than that approved in accordance with this condition.

 

Reason:  In the interests of highway safety and to comply with policy TR7 (Highway Considerations) of the Isle of Wight Unitary Development Plan.

Decision:

The application was refused contrary to officer recommendation as members believed that information accompanying the application was inadequate and deficient in detail in respect of a road safety audit to enable the Authority to consider the impact of the proposal on highway safety.  In addition, permission was refused on the grounds that there was insufficient capacity in the foul and surface water drainage system to serve the development.

 

In compliance with the Council’s Constitution a named vote was taken as the decision was contrary to officer recommendation.

20.         The implementation of work required for the translocation of Great Crested Newts on site shall be carried out in accordance with an agreed programme which shall comply with the chronological order indicated in the EPR (Ecology Planning and Research) Report including mitigation work schedule Appendix 2 with that report which accompanied TCP/22128/C, and there shall be no deviation from any agreed programme without the prior written consent of the Local Planning Authority and such works shall be supervised by a suitably qualified and licensed ecologist.

 

Reason: In the interest of ensuring the appropriate translocation of the Great Crested Newts which are protected under the Wildlife and Countryside Act 1981 and the European Habitats Directive in compliance with Policy C8 (Nature Conservation as a Material Consideration) of the Isle of Wight Unitary Development Plan.

 

21.         Prior to commencement of any works on site, an up to date survey must be completed by a suitably qualified ecologist consultant identify if any active badger sets are located the land. The details of which must be supplied to and approved in writing by the Local Planning Authority before any construction works hereby approved commence on site.

Reason: In the interest of the amenities of the area and to comply with Policy C8 (Nature Conservation as a Material Consideration) of the Isle of Wight Unitary Development Plan.

 

22.             Prior to commencement of any works on site, further translocation of reptiles shall be undertaken with a report of the results of this work, detailing the receptor sites used, shall be submitted to and approved to the satisfaction of the Local Planning Authority. Any further translocation required while works are being undertaken shall be completed to the satisfaction of the Local Planning Authority.

 

Reason: In the interest of the amenities of the area and to comply with Policy C8 (Nature Conservation as a Material Consideration) of the Isle of Wight Unitary Development Plan.

 

23.             No tree or scrub clearance shall be undertaken on site within the months of March to September inclusive. 

 

Reason: To avoid disturbance to nesting birds which are protected under the Wildlife and Countryside Act 1981 and in accordance with Policy C8 (Nature Conservation as a Material Consideration) of the Isle of Wight Unitary Development Plan.

 

24.            L 19 - Lorry Routing

 

For clarity Condition 8 to be reworded as follows :

 

8.                The development hereby approved shall not commence until a Section 106 Agreement and a Section 38 Agreement are in place for the adoption of the spine road from the junction with the adopted section of Sylvan Drive through to and including its junction with the adopted section of Mountbatten Drive, including Snowberry Close.

Reasons:

1. 2. 3. The rear section of the proposed building comprising flat 1, by reason of its excessive depth, height and position close to the northern boundary of the site would be an intrusive and unneighbourly addition, out of scale and character with this and surrounding dwellings as well as having a serious and adverse effect on the amenities enjoyed by occupants of the neighbouring property causing loss of light and outlook as well as being overbearing and would be contrary to Policy S6 (Be of a High Standard of Design) and Policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.

 

4. The proposed parking, by reason of its position at the back of the properties and in close proximity to the northern boundary would result in an unacceptable degree of disturbance to the detriment of the amenities currently enjoyed by the adjoining property occupiers. Accordingly, the proposal is considered contrary to Policy D1 (Standards of Design) of the Isle of Wight Unitary Development Plan.
