RESOLVED :
THAT the Minutes of the meeting held on 18 October 2005 be confirmed.

Interests were declared in the following matters:
Cllr Mike Cunningham declared a personal interest in Minutes 26 (a) 2 – Land north of Cliff Farm and south of Hornhill Copse west of Rew Street, Cowes, as he was the Council’s representative on CAMS.

The Committee had taken into consideration and
agreed with the reasons for the recommendation as set out under paragraph
entitled Justification for Recommendation of the report and resolved: Conditional planning permission, subject to the
conditions set out in the Part II Register and to include a requirement to
enter into a Section 106 Agreement. Additional conditions to be added with reference
to a badger survey and that the tower would only be used for light and
ventilation purposes. |

Prior to any other works commencing on
site including site clearance, a badger survey should be carried out by a
suitably qualified ecological consultant and the results of any such survey
shall be submitted to the Local Planning Authority in order to establish
whether the site contains badger activity.
In the event of any such badger activity the survey report shall
include provision for mitigating measures which shall be approved by the
Local Planning Authority prior to any other works taking place. (Applicant is advised that a development
licence from the Wildlife Licensing Division DEFRA will be required before
any works can be undertaken in the event of badgers being found on the site). Reason: To allow the proper consideration of the
impact of the proposed development and contribution of nature conservation
interest of the amenities of the area and to comply with Policy C8 (Nature
Conservation as a Material Consideration) of the Isle of Wight Unitary

letter was received from the RSPB advising that their key interests in the
area were the Solent and Southampton Water SPA and RAMSAR site and the Solent
Maritime SAC. The
Highway Engineer recommended modification to the condition in respect of
lorry routing to ensure that all traffic relating to the approved application
would deliver, load and unload at a time on a route approved in writing by
the Traffic Section of Engineering Services. Environmental
Health gave consideration to noise emissions from the operations and asked
for certain issues to be addressed. |

Comment: |

Decision: |
The
application was refused contrary to officer recommendation as members
believed it would be overdevelopment of the site and create conditions that
were hostile which would encourage crime and disorder. In
compliance with the Council’s Constitution a named vote was taken as the
application was contrary to officer recommendation. The
voting was as follows: For (7)

accordance with the Code of Practice Cllr Muriel Miller had not been present
throughout the whole of the consideration of the item and therefore did not
vote. |

Reasons: |
Overdevelopment
of the site, which in turn would result in a cramped appearance and create
conditions likely to give rise to overlooking, loss of outlook and be of an
overbearing nature to the detriment of the amenities of neighbouring
properties and prospective occupants of the proposed units, as well as being
out of character with the prevailing pattern of development in the
surrounding area. There
was also inadequate parking provision which, when combined with the loss of
existing parking facilities, would place increased pressure on ‘on street’
parking, further exacerbating difficulties in relation to manoeuvring, access
and congestion, due to the inadequacy of the local road network, which would
interrupt the free flow of traffic and thereby add to the hazards of road

Completed and Outstanding Section 106
Obligations – Quarterly Report
The Interim Development
Control Manager updated members on Section 106 Agreements to year ending 30
September 2005.
RESOLVED :
THAT the report be noted.
(c)
Planning Performance – Quarterly Report
Members were advised that
the Council had received approximately 2,400 applications in each 12 month
period since early 2004. Of these 3%
were classified as major applications, 42% were minor and the balance, some 55%
were other. The Island handled
significantly more minor applications than the national average. Appeal outcomes were better than average
nationally.
Failure to attain, and
maintain, targets could lead to a Local Planning Authority being classified as
a ‘standards authority’. The Head of
Planning Services told the Committee that there was a real possibility that the
Isle of Wight Council would be classified by the Office of the Deputy Prime
Minister as a standards authority for major applications in 2006/07. It was anticipated that a whole batch of
major applications would be submitted during the next few months.
An additional meeting had
been arranged to take place on 20 December 2005 which would be specifically for
consideration major applications.
RESOLVED :
THAT the report be noted.
27. URGENT BUSINESS – TCP/11878/E PRIORY SCHOOL, ALVERSTONE ROAD, SHANKLIN
The Chairman agreed to an item of urgent business as clarification of the reasons for a previous decision was needed.
A report was circulated and members had a five minute break in which to read the document.
Members were reminded who had previously voted in favour of the application and who would therefore be eligible to vote on the clarification. It was noted that Councillor David Whittaker had previously declared a personal and prejudicial interest and had taken no part in the discussion and voting thereon.
Members were told that due to an oversight the reasons for the decision taken contrary to officer recommendation for TCP/11878/E Priory School, Alverstone Road, Shanklin were not formally minuted at the meeting of 6 September 2005. The Committee was advised that this was not an opportunity to re-debate the application or reconsider the decision.
RESOLVED :
THAT the following was a true representation of the reasons for the decision taken :
Members noted that the additional information submitted since the earlier meeting and that the officers’ advice was that it met some of their originally recommended reasons for refusal. Whilst acknowledging that the access was, and would remain, substandard in terms of visibility, given the revised scheme within the site and subject to the imposition of appropriate conditions to further improve the access and enforce the travel plan that on balance the proposal was acceptable for a trial period of 2 academic years. During this period the school should be encouraged to look for a more suitable location.
28.
MEMBERS' QUESTION TIME
Cllr
George Cameron asked if PPG 13 could be manipulated to suit the Isle of Wight
and was told that would be extremely difficult to do.
Cllr
Brian Mosdell asked if Enforcement was going to be snowed under with Section
106 Agreements, he was advised that a system was being devised whereby a
trigger would show when monies were due.
